یادداشتی پیرامون قانون ممنوعیت یا محدودیت نگهداری از حیوانات خانگی مضر

مدتی است که از ارائه طرح 39 تن از نمایندگان محترم مجلس در ارتباط با ممنوعیت و یا محدودیت در نگهداری حیوانات خطرناک و مضر برای سلامت عمومی به مجلس شورای اسلامی می گذرد.

بسیار مشتاق بودم تا واکنش نهادهای قانونی مرتبط با دامپزشکی را در مقابل این طرح شاهد باشم تا بتوانم به ارزیابی کاملی در ارتباط با شرایط موجود بر دامپزشکی حیوانات خانگی کشور دست یابم و با وجود اطمیتان از انفعال نهادهای ذیربط بار دیگر این اطمینان برایم اثبات گردید که بجز چند نهاد غیر دولتی حامی حیوانات و چند تن از همکاران با غیرت شاغل در بخش خصوصی هنوز بقیه مسئولین و همکاران را نوعی خواب خرگوشی فرا گرفته و هیچکدام به ابعاد اتفاقی که در صورت عدم واکنش به موقع احتمال بروز دارد تفکری یا بهتر بگویم تفکر با تعمقی نمی نمایند.(متاسفانه)

لذا بر آن شدم تا با نوشتن این چند خط به بررسی دقیق تر تمامی بخشهای طرح مذکور بپردازم. امیدوارم که همکاران محترم نیز با همیاری خود و خارج شدن از حالت بی تفاوتی نسبت به وقایع این صنف واکنشی درخور نشان دهند.
در بخش اول طرح پیشنهادی نمایندگان محترم ̨ نگهداری از حیوانات خانگی به خصوص سگ دارای مضرات بسیار بهداشتی دانسته اند و بیرون آوردن سگ را رواج سگ گردانی نامیده اند. به عقیده اینجانب عدم اطلاع نمایندگان محترم از مسائل بهداشتی حیوانات خانگی منجر به همچین ادعایی گردیده است زیرا مخاطرات بهداشتی حیوانات صاحب دار (سگ یا گربه) که توسط صاحبشان در خیابان گردانده میشوند مطمئنا بسیار اندک است. زیرا صاحب حیوانی که برای پیاده روی حیوانش اهمیت قائل است بی شک به مسائلی نظیر واکسیناسیون ودرمان ضد انگلی و یا سایر بیماریهای حیوانش نیز حساس است و بنابراین موارد بهداشتی در این مورد را رعایت می کند. همچنین پیاده روی حیوان در خیابان̨ سگ گردانی نامیده شده است که صفتی نکوهیده به نظر می رسد. سوال نویسنده این است کدام موجود زنده را می شناسید که بتوان آنرا در یک چهار دیواری محصور نمود و انتظار داشت به هیچ مرضی مبتلا نگردد؟ بسیاری از بیماریها نظیر نرمی استخوان̨ چاقی̨ دیابت و ... می تواند در اثر عدم استفاده از نور خورشید و یا عدم تحرک کافی باشد ضمن اینکه در درمان بسیاری بیماریها نیز توصیه دامپزشک بر افزایش تحرک و فعالیت بدنی می باشد. لذا هرگونه مشاهده حیوان در خیابان را نمی توان فقط مشکل فرهنگی دانست. همچنین نمایندگان محترم نمی توانند منکر تعداد زیاد حیوان خانگی به خصوص در شهرهای بزرگ باشند اما آیا حتی یک مرکز جهت رفع نیازهای مذکور برای حیوانات در نظر گرفته شده که انتظار عدم مشاهده آنها در معابر یا پارکها را داشته باشیم؟ مسلما جواب خیر است در حالیکه تقریبا در تمامی کشورهای دنیا مکانهایی ویژه برای حیوانات خانگی وجود دارد و یا حتی اگر به صورت اختصاصی چنین مراکزی وجود نداشته باشد در بسیاری از پارکها بر خلاف کشور ما محدودیتی برای ورود حیوانات خانگی وجود ندارد.
در ادامه طرح پیشنهادی ̨ نگهداری حیوان خانگی نوعی معضل فرهنگی اجتماعی و تقلید کورکورانه از فرهنگ مبتذل غربی نامیده شده است. به نظر می رسد این بخش از طرح نیز با بی مهری نسبت به تاریخ و تمدن ایران باستان تدوین گردیده است لذا بر خود واجب می دانم چند نکته را یاد آوری نمایم:
الف) فیثاغورث در سفرنامه خود در مورد زرتشت می نویسد: زرتشت از فن دامپزشکی و درمان حیوانات اطلاع داشته و در کتاب اوستا می توان نکات متعددی درباره درمان بیماریهای دام مشاهده کرد. http://www.vetnews.ir/fa/images/stories/a1majles.jpg
ب) آریایی ها اولین قومی بودند که سگ را اهلی نمودند
ج) از سگ سالوکی در ارتش ایرانیان باستان در جنگ با رومیان استفاده شده است.
مثالهای بی شمار دیگری نیز موجود است که باعث تصدیع کلام می شود.
پس مشاهده می شود نگهداری از حیوانی نظیر سگ نه تنها تقلید کورکورانه از فرهنگ مبتذل غربی نیست بلکه این غربیها هستند که مانند بسیاری موارد دیگر این مساله را از ما به عاریت گرفته اند.
در بخش بعدی محدودیت هایی برای نگهداری حیوان پیشنهاد گردیده و جزایی نیز برای متخلفان در نظر گرفته شده است که از آن جمله محدودیت تردد حیوانات در معابر ̨ اماکن حتی با وسائل نقلیه عنوان شده است.
ذکر گردیده نگهداری در آپارتمان ممنوع و یا اگر در منزل غیر آپارتمانی موجب نارضایتی هر کدام از ساکنان گردد ممنوع است. سوال اینجاست که چنانچه فردی سگی را در منزلی ویلایی و با رضایت تمامی ساکنین نگهداری نمود که بر اساس این طرح کاری غیر قانونی نیست و روزی این سگ دچار بیماری شد که باید آنرا به مرکزی درمانی انتقال دهند ̨ چگونه این کار انجام شود؟(با توجه به ممنوعیت حمل ونقل با اتوموبیل)یا افرادی که اکنون دارای حیوان خانگی در آپارتمان خود هستند با اجرای این طرح با حیوان خود باید چه کار کنند؟
مطمئنا از حقوق حیوانات بر صاحبانشان بیش از اینجانب مطلعید ولی جهت یاد آوری به چند نکته اشاره می نمایم:
1) نفقه حیوان اعم است از غذا̨ آشامیدن ̨ مسکن̨ دارو و هر ماده ضروری برای معیشت و ادامه حیات . پس نمی توان از عدم پرداخت چنین حق واجب شرعی که حیوان بر گردن صاحبش دارد گذشت و آنرا فقط در منزل نکهداری کرد و از خانه خارج ننمود( به عنوان مثال برای درمان).
2) از وظایف حاکم بر نفقه حیوان این است که اگر صاحب حیوان از انجام وظایف خود در اداره حیوان خودداری کند̨ حاکم نخست باید او را ارشاد و مجبور اداره زندگی حیوان کند و اگر صاحب حیوان اجابت نکرد حاکم باید راه دیگری که حیوان را از فشار برهاند اتخاذ نماید . بنابراین قانونگذار باید به اختلاف طرح پیشنهادی با شرع نیز توجه داشته باشد نه اینکه در طرح خود به این مساله بی توجه باشد و بالعکس صاحب حیوان را مجبور به راندن حیوان خود نماید
3) همچنین قرآن به وجود شعور در حیوانات معتقد است و از این رو حتی از آزار روحی آنها نیز انسان را پرهیز داده است.همچنین روایات بسیاری در نکوهش آزار و اذیت حیوانات وجود دارد و با فرض اینکه رها نمودن حیوانات به حال خود که پیرو اجرایی شدن این طرح ایجاد می گردد باعث آزار حیوان می شود به آنها اشاره می کنیم:
الف) حضرت علی (ع) فرموده اند خدا لعنت کند کسی را که حیوان را لعنت می کند.
ب) امام سجاد در سفر حج پس از پاره شدن لباس هایشان توسط شتر به او تازیانه نزدند و علت را قصاص در قیامت فرمودند که این امر مواخذه روز قیامت در بد رفتاری با حیوان را عیان می سازد.

دین مبین اسلام که حتی برای دوشیدن بیش از حد حیوانی که دارای بچه شیرخوار است حرمت قائل می شود و برای جلوگیری از گرسنگی زنبوران داخل کندو برداشت بیش از حد عسل از کندو را محدود می نماید مطمئنا با آزار شدیدی که با اجرای این طرح به حیوان تحمیل می شود همسو نیست .
بخش پایان طرح نیز شاید ابهام انگیزترین بخش این طرح محسوب شود آنجایی که به وزارت بهداشت ماموریت داده می شود حیوانات خطرناک و مضر برای سلامت عمومی و نجس العین را معرفی نماید.
یادآوری می گردد وظیفه مستقیم سیاست گذاری ̨ تصمیم گیری و اجرا ی هر گونه دستورالعمل در مورد حیوانات توسط سازمان دامپزشکی کشور انجام می پذیرد و به فرض اینکه حیوانات مضر برای سلامت عمومی باید مشخص گردند وظیفه این کار با وزارت بهداشت نیست . ضمن اینکه نویسنده معتقد است سازمان دامپزشکی درگیر مسائل بهداشتی بسیار مهمتری نظیر آنفولانزای پرندگان و غیره می باشد و شاید کمتر فرصت تحقیق در مورد مضرات و خطرات حیوانات را دارد. علاوه بر این مطمئنا اگر بنا باشد حیوانات خطرناک برای سلامت عمومی معرفی گردند مرغ و خروس در مرتبه اول قرار خواهند گرفت که روزانه صدها هزار قطعه از آنها به دلیل بیماری حاد تنفسی قابل انتقال و کشنده به انسان در حال معدوم سازی هستند و حتی صحبتی از این خطر بالقوه که می تواند یک تراژدی انسانی به بار بیاورد نمی شود.
در خاتمه به این نکته نیز اشاره می شود تعیین نجاست العین بودن یک حیوان نیز در صلاحیت وزارت بهداشت و کارشناسان آن نمی باشد و یک مساله شرعی است که به اظهار نظر علما نیاز دارد.
